Caldicott Advisory Panel decision letter PHE Caldicott Advisory Panel regularly reviews surveillance programmes where data is collected without direct patient consent under Regulation 3 of the Health Service (Control of Patient Information) Regulations 2002. In the most recent review of the Mandatory Surveillance of Healthcare Associated Bloodstream Infections and Clostridium difficile Infection the panel make it clear that the legal cover is for all users and organisation contributing to the surveillance not just PHE, previously this was slightly ambiguous.
